GTC – General Terms and Conditions

  1. Scope
    These General Terms and Conditions (GTC) apply to all contracts and services between Handler Analytics (hereinafter „Provider“) and its customers (hereinafter „Customer“) concluded via the website handler-analytics.com, by email, or through other remote communication means.
  2. Object of the Contract
    The Provider provides analytical technology services and software solutions to the Customer, the precise description and scope of which are outlined on the Provider’s website and in the respective offer documents.
  3. Conclusion of Contract
    A contract is concluded when the Customer accepts an offer from the Provider. This can be done in writing, by email, or by using an online order form.
  4. Services and Obligations of the Provider
    The Provider undertakes to provide the agreed services and products to the best of its knowledge and belief and in compliance with applicable standards and technologies. The Provider reserves the right to engage subcontractors.
  5. Services and Obligations of the Customer
    The Customer undertakes to provide the Provider with all necessary information and data for the provision of the service in a timely manner. The Customer warrants that they have the necessary rights to the provided data.
  6. Prices and Payment Terms
    The prices for the services and products provided by the Provider are listed in the respective offer documents. Invoices are payable within 14 days of invoicing without deduction.
  7. Data Protection
    The Provider undertakes to handle all data received from the Customer in accordance with the General Data Protection Regulation (GDPR) and other relevant data protection regulations.
  8. Liability
    The Provider’s liability for damages caused by slight negligence is excluded unless such damages result from the breach of essential contractual obligations.
  9. Changes to the GTC
    The Provider reserves the right to amend these GTC at any time. The amended conditions will be communicated to the Customer no later than two weeks before they come into effect.
  10. Final Provisions
    Should individual provisions of these GTC be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. Instead of the invalid or unenforceable provision, a reasonable provision shall apply that comes closest to what the contracting parties intended.
